			<content:encoded><![CDATA[<p>I will be looking for a home and have interviewed someone to act as a buyer&#8217;s agent. I have not signed the contract, but she was nice enough to let me take a copy home to read. I really like her as a person and think she will work hard, but I&#8217;m not crazy about the contract (actually, neither is she), which was written by the company she works for.<br />
It states that, although the seller is usually responsible for commission, I will have to pay the difference if the seller doesn&#8217;t pay the full amount.<br />
They&#8217;ve set the commission at 7%, so I could be responsible for 3.5% (or the full 7% in a FSBO sale). This rate sounds high to me. I&#8217;m in Pennsylvania, not sure if that makes a difference.<br />
Is the commission negotiable?<br />
There is also an administrative fee of 5 for document preparation ??<br />
Even if she works for a company, I wonder if I could still negotiate the commission with her&#8230;

I have not signed the contract, but she was nice enough to let me take a copy home to read. I really like her as a person and think she will work hard, but I&#8217;m not crazy about the contract (actually, neither is she), which was written by the company she works for.<br />

			<content:encoded><![CDATA[<p>I&#8217;ve painted, refloored, staged, showed, written ads, adjusted prices, advertised myself even!!   She hasn&#8217;t spent a dime on advertising.  Now I&#8217;m trying to get creative with helping sellers with closing costs/points, I write to her, she ignores me until I trap her on the phone.  I know I&#8217;m screwed with the mafia MLS system, and I signed a 6 month contract (which I can revoke but it&#8217;ll create a lot of trouble) but WTF???  Why can&#8217;t I sue her and her broker for being the lazy-asses they are (after a sale)&#8212;they don&#8217;t deserve anything for any work.  I&#8217;ve sold a house myself before, the contracts are not hard, 10 minutes tops to fill everything out, went through closing without a hitch, that house was 0,000.  The MLS mafia is just too tight in certain geographic areas to fsbo all houses.</p>
<p>Has anyone ever sued for incompetency or failure to perform?  I know a contract is a contract, but there&#8217;s got to be qualifications.<br />
Since when is 6% a LOW commission??  3% goes to buyers&#8217; agents, 3% to sellers&#8230;if that&#8217;s low, then it&#8217;s time for WAR, agents make too much for what they do and if it weren&#8217;t for the MLS mafia nobody&#8217;d hire them, but they&#8217;ve painted poor homebuyers and sellers into a corner.  If a buyer had to actually PAY that ,000 to be shown some houses, they&#8217;d laugh in the face of those buyer&#8217;s agents, if they didn&#8217;t knock them over first, for the gall of it all.  That&#8217;s why they screw over the seller for monies.  It&#8217;s all unfair, and it will end one day.

There is a FSBO property I am very interested in, which I did not find through my realtor (in fact, found in advance of working with her).  The realtor has sent me listings, but she has not yet showed us any homes (we live out of state and will be going this week to do a house hunting trip), and plans to have us sign a contract with her before looking at homes. I don&#8217;t want to put all my eggs in one basket, but I am heavily leaning towards the FSBO.  I am planning to go look at the FSBO first, and then see what homes the realtor has to show.  The FSBO already has two offers, but the owner is an acquaintance who is willing to wait until we look and potentially make an offer, and we therefore know that we have a much better chance of getting the house if we will not be requiring them to pay a 3% commission.  Sooo&#8230; in this situation, if we have signed an agreement to have her represent us but then decide we want to purchase a home outside the scope of what the agent has shown us, what is our obligation to her?  Will she still have claim on a commission, or can we just say, &quot;we have decided not to buy?&quot; and proceed privately with the transaction?

<p>Sorry for this late reply but I was unable to check my e-mail until now. The car is in good running condition and comes with a clear title. There is no lien on it there will be no monthly payments no take over payments just final price. It&#8217;s a non smoker car with zero mechanical/electrical problems no damages or accidents.<br />
I am looking to sell it right away for 00 (shipping and title transfer fees included). There is a reason for selling it for such a low price but it&#8217;s just something personal that has nothing to do with the car&#8217;s condition and I&#8217;m not willing to discuss it so please don&#8217;t ask.<br />
I would like to use a third party service to handle this transaction for our both safety and comfort. Yahoo Autos offers a third party service of course for a small fee. I have applied and I&#8217;m willing to pay for their fee if you agree using their service. I&#8217;m currently stationed in Camp Bucca Southern Iraq had nobody back home that could help me with the sale so I&#8217;ve left the car at the Yahoo Autos Depot and they will take care of the shipping/payment.<br />
If you are interested please go to autos.yahoo.com and click the sign up link in order to register (activate your e-mail account too) then get back to me with you user id so I can contact Yahoo and ask them to provide you the details about the transaction process.<br />

We live in the country&#8230;.the nearest neighbor is 2 miles away. I&#8217;m home a lot by myself throughout the day. We have signs by the road saying out home is for sale by owner. With that sign is our phone numbers (easily to see from the road). I&#8217;m making flyers to put out on the sign to give people more of a listing sheet to know basic information. Anyways, we&#8217;ve had a lot of people just wandering through our yard and even a few knocking on the door. How do I prevent this in a nice way? I don&#8217;t really want to get those big orange &quot;No Trespassing&quot; signs&#8230;I will if I have to but I don&#8217;t want to look deliverance like. I&#8217;d like to put something on the &quot;Info box&quot; about respecting our privacy. Anyone have a tactful way of doing this? I&#8217;m all for showing my home&#8230;when I know people are coming. However more than once I&#8217;ve been caught jumping in/out of the shower. So please, if anyone can come up with a pleasant way of saying &quot;by appointment only&quot; to make people think please let me know!

			<content:encoded><![CDATA[<p>A realtor is coming to my home in december to assess what all upgrades, repairs, etc i need to make before I put it up for sale.  I&#8217;m now thinking of trying a FSBO.  If the realtor comes to my home, are they &quot;expecting&quot; me to sign a contract with them, or would I be free to have a few other realtors come over and give me their opinion and chose them instead, or ultimately try to sell it on my own?<br />
**Also, I&#8217;m not trying to be unfair to a realtor!  My hubby is s/e and I know it&#8217;s tough to work on comission right now.  My only reason for wanting to do FSBO is b/c I owe k on my home and I&#8217;m just trying to make enough to pay that and closing costs.  Thats a great price for my home, and if I hire a real estate agent, I&#8217;ll have to up my price k or so to pay for their 6% and it makes my home &quot;more expensive&quot;</p>
<p>Also incase anyone was wondering, I&#8217;m in decatur, al.  The market is actually pretty good here. 2200 sq ft. 4bdrm, 3 bath, hardwood.  </p>
<p>I&#8217;m just young and not up to staying home all the time and maintaining a house ;D

Sorry for this late reply but I was unable to check my e-mail until now. The car is in good running condition and comes with a clear title. There is no lien on it there will be no monthly payments no take over payments just final price. It&#8217;s a non smoker car with zero mechanical/electrical problems no damages or accidents.<br />
I am looking to sell it right away for 00 (shipping and title transfer fees included). There is a reason for selling it for such a low price but it&#8217;s just something personal that has nothing to do with the car&#8217;s condition and I&#8217;m not willing to discuss it so please don&#8217;t ask.<br />
I would like to use a third party service to handle this transaction for our both safety and comfort. Yahoo Autos offers a third party service of course for a small fee. I have applied and I&#8217;m willing to pay for their fee if you agree using their service.
